Affiliate Terms
I. Introduction and Scope of Agreement
These Affiliate Terms & Conditions ("Affiliate Terms") govern participation in the Smairthub Affiliate Program ("Affiliate Program") operated by Kiraly Ingrid EV (registered address: 13 Szőlőskert St., Győr, 9030, Hungary, tax number: HU92213159, sole proprietor registration number: 62565408, hereinafter: "Provider").
By registering for the Affiliate Program or using customized referral links, the Affiliate explicitly agrees that they have read, understood, and agreed to be legally bound by these Affiliate Terms.
II. Eligibility and Invoicing Requirements
1. Eligibility
Participation in the Affiliate Program is strictly available to legal entities, sole proprietorships, registered businesses, and individuals capable of issuing valid tax invoices.
2. Mandatory Invoicing Capability
Payouts can strictly only be issued to Affiliates who can provide a valid, legally compliant business invoice (containing valid sole proprietorship or company registration data) to the Provider. Payouts cannot be processed to private individuals without invoicing capability.
III. Commissions, Tracking, and Payouts
1. Commission Rate (20% Lifetime)
The Provider grants a 20% recurring lifetime commission on all valid credit purchase transactions made by users referred through the Affiliate's unique link. Commissions are calculated based on the net value (excluding VAT/sales tax) of the paid amount.
2. Cookie Lifespan
Referral link tracking operates with a 60-day cookie window. If a referred visitor signs up on the Smairthub platform within 60 days of clicking the referral link, their account is permanently assigned to the Affiliate.
3. Minimum Payout Threshold
Commission payouts can be requested once the Affiliate's accumulated, approved balance reaches the minimum threshold of $50 (Fifty US Dollars).
4. Payout Cycle and Methods
Payouts are processed monthly, by the 15th day of the month following the earning period, upon receipt and validation of a proper business invoice. Payouts are executed via Wise, Stripe Connect, or direct bank transfer.
5. Refunds and Chargebacks
If a referred customer requests a refund or initiates a credit card chargeback, any associated pending or paid commission will be automatically reversed and deducted from the Affiliate's balance.
IV. Prohibited Promotional Practices (Anti-Abuse)
The Affiliate unconditionally agrees to refrain from the following unfair or prohibited promotional tactics:
- Brand Bidding Prohibition: Bidding on search engine keywords containing "Smairthub", "SmairHub", or common misspellings in paid ad campaigns (e.g., Google Ads, Bing Ads) using direct affiliate links is strictly prohibited.
- Spam and Unsolicited Messaging: Using unsolicited emails (SPAM), automated social media messages, or deceptive advertising is forbidden.
- Self-Referrals: Affiliates are not permitted to use their own affiliate link to register personal Smairthub accounts or purchase credits for personal use to gain commission.
- Misleading Claims: Advertising non-existent discounts, fake features, or claiming official representation of Smairthub is prohibited.
V. Provider Rights and Account Termination
If the Provider identifies reasonable suspicion or evidence of a violation of these Affiliate Terms (e.g., Brand Bidding, Self-referrals, SPAM), the Provider reserves the right to:
- immediately suspend or terminate the Affiliate's account,
- cancel and forfeit any commission balance acquired through fraudulent or prohibited means.
VI. Limitation of Liability
The Provider makes no guarantees regarding minimum earnings or conversions. The Provider is not liable for technical outages of third-party tracking platforms (e.g., FirstPromoter) or unrecorded referrals resulting from browser ad/cookie blockers.
VII. Amendments and Contact
The Provider reserves the right to update these Affiliate Terms at any time. Notice of changes will be communicated via email or through the FirstPromoter dashboard.
